Errors and Omissions

Errors & Omissions (E&O) Insurance covers legal liability and defense for the production company against lawsuits alleging unauthorized use of title, format, ideas, characters, plots, plagiarism, and unfair competitions. The policy also protects for alleged libel, slander, defamation of character, or invasion of privacy.

Script or other written material must be read and approved by the insurance company's underwriter attorneys. Script clearance rights must be obtained for materials used, titles, etc.

E & O endorsements along with exclusions include the following:
  • Music Exclusion & Special Provisions (unless declared)
  • Film Clips (exclusion)
  • Injunction Coverage (exclusion)
  • Punitive Damages Coverage
  • Manuscript blanket included
  • Most favorable venue
  • Acquisition & Development Coverage on Existing Production
  • Defense Outside Limits
  • Additional Insured Endorsement
