Workers' Compensation

When considering Workers' Compensation for the entertainment industry, there are several key concerns. The most basic is answering the question, "Who is an employee?" When working on a film project, the set may be filled with full-time employees, contracted individuals, performers who receive a salary from the studio, extras, etc.

Another concern is how the payroll services are handled. However, in this lesson we will focus on two areas of particular interest to Workers' Compensation in entertainment: loan out corporations and Guild Travel Accident Insurance.

Loan out corporations
In the eyes of insurance, the loan out corporation employs the entertainer and "loans out" his or her services in connection with a production in the entertainment industry. Suitable coverages by a loan out corporation may include:
  • Workers' Compensation
  • Comprehensive General Liability
  • Comprehensive Automobile Liability

    Guild Travel Accident Insurance
Guild Travel Accident Insurance provides travel or accident coverages as required by guild or union contracts signed by the producer. Coverage may be extended to cover non-union employees. This protection is designed to meet the requirements of all guilds, including these entertainment guilds:
  • Screen Actor's Guild (SAG)
  • Director's Guild of America (DGA)
  • Writer's Guild of America (WGA)
  • Screen Extra's Guild (SEG)

Want a short list of the various cast and crew positions involved in a feature film or TV show. Good luck. The next time you are in a theater, watch the list of credits as it rolls at the end of the movie. The list often moves so quickly that you barely have time to make out the names...and yet the list seems to run on forever. What exactly is a Dolly Grip or a Best Boy or a Sound Engineer?

The point is this: when you insure an entertainment project, clearly one of the main issues to bear in mind is Workers' Compensation, given the vast number of people who in one way or another have a hand in the project.
